November 9, 2010 This action notifies the public that the Environmental Protection Agency has received a petition for rulemaking from Friends of the Earth (FOE) and another separate request for rulemaking under section 312 of the Clean Water Act. In general these rulemaking related requests ask EPA to revise its regulations establishing performance standards for vessel sewage treatment devices under the CWA. The rulemaking petition from FOE also requests that EPA establish monitoring, recordkeeping and reporting requirements under the CWA to ensure compliance with the performance standards. EPA has not made a decision on whether to grant or deny the rulemaking requests, nor is the Agency proposing any changes to the performance standards or other provisions of its regulations at this time. Rather, the purpose of the Notice is simply to make the public aware of the issues raised in the requests for rulemaking and to obtain the public’s input, in the form of comments and relevant information, to help EPA determine appropriate action in response to each of these requests. In particular, EPA seeks input regarding: The universe of vessels operating on navigable waters that use sewage treatment devices; technical information on the performance, effectiveness and costs of vessel sewage treatment devices, including performance testing data; suggestions on what, if any, changes to the performance standards might be appropriate; and information on monitoring, recordkeeping and reporting approaches for vessel sewage discharges. September 10, 2010 Agency Notice (Meeting) – The Shipping Coordinating (SHC) will conduct two separate open meetings, at the United States Coast Guard Headquarters Building, 2100 Second Street, SW., Washington, DC. The primary purpose of the meeting is to prepare for the sixty-first Session of the International Maritime Organization Marine Environmental Protection Committee to be held at the IMO headquarters in London, United Kingdom. October 1, 2010 Agency Notice (Final Rule) – The Department of Transportation is amending certain provisions of its drug testing procedures dealing with laboratory testing of urine specimens. Some of the changes will also affect the training of and procedures used by Medical Review Officers. The changes are intended to create consistency with many, but not all, of the new requirements established by the U.S. Department of Health and Human Services. 75 FR 49850, (August 16, 2010), (OST-2010-0026).
October 4, 2010 Agency Notice (Final Rule) – The Transportation Department is issuing a new Americans with Disabilities Act (ADA) rule to ensure nondiscrimination on the basis of disability by passenger vessel operators (PVOs). This rulemaking concerns service and policy issues. Issues concerning physical accessibility standards will be addressed at a later time, in conjunction with proposed passenger vessel accessibility guidelines drafted by the United States Access Board. The Department is also seeking further comment on three issues, concerning emotional support animals, mobility aids, and the relationship of DOT and DOJ rules. The rule is effective November 3, 2010.
